Release Agreement

This agreement releases James Scott Whitesell, dba South Swell Surf School, and The City of Charleston, SC from all liability relating to injuries that may occur during a Surfing Lesson or a Surfboard Rental. By signing this agreement, I agree to hold James Scott Whitesell, dba South Swell Surf School, and The City of Charleston, SC entirely free from liability, including financial responsibility for injuries incurred, regardless of whether injuries are caused by negligence.

I also acknowledge the risks involved in Surfing. These include but are not limited to Injury, Drowning and Death. I swear that I am participating voluntarily, and that all risks have been made clear to me. Additionally, I do not have any conditions that will increase my likelihood of experiencing injuries while engaging in this activity.

By signing below, I forfeit all right to bring suit against James Scott Whitesell, dba South Swell Surf School, and The City of Charleston, SC for any reason. In return, I will receive a Surfing Lesson / Surfboard Rental. I will also make every effort to obey safety precautions as listed in writing and explained to me verbally. I will ask for clarification when needed.

For equipment and rentals customer is responsible for damage, loss, or theft to surfboard or other equipment.

All equipment must be returned without sand or debris or pay a $5 cleaning fee.

No use of the rented equipment is permitted within any restricted areas, or within 3 blocks of the pier, jetty, or other structure, regardless of city allowances, to ensure the users safety.

I agree to disclose my physical limitations, disabilities, ailments, or impairments which may affect my ability to participate in this program.

I declare that I, along with all minors listed, have read and agree to all terms of the agreement written above.
